Marketplace Terms of Use

These Terms of Use govern access to and use of PFine Real Estate Cloud, including the public marketplace, workspace accounts, listing tools, paid exposure products, enquiry tools, and related services. By accessing or using the platform, you agree to these terms.

1. Platform Role

PFine Real Estate Cloud provides a digital marketplace and workflow system for property discovery, listing submission, paid exposure, lead handling, and campaign management. Unless expressly stated otherwise in writing, the platform does not act as the buyer, seller, landlord, tenant, surveyor, valuer, advocate, broker, escrow agent, or guarantor in a transaction.

2. Eligibility and Accounts

Users must provide accurate registration information, keep credentials secure, and use the workspace only for lawful marketplace activity. You are responsible for actions taken through your account and for ensuring listing data, contact data, and supporting materials are truthful, current, and lawful to publish.

3. Listing Standards

By submitting a listing, request, or campaign, you represent that you have the right to publish the content, images, contact details, and commercial information supplied. False, misleading, infringing, fraudulent, abusive, duplicated, or unlawful content may be suspended, rejected, edited for compliance, or removed without prior notice.

4. Review, Moderation, and Staff Protections

PFine Real Estate Cloud may review, classify, pause, reject, remove, or request clarification for submissions where compliance, authenticity, safety, fraud prevention, payment validation, content quality, or legal risk requires intervention. Platform staff and contractors may act in good faith to moderate content, manage abuse, investigate complaints, and preserve system integrity without creating fiduciary duties to any party.

5. Paid Products and Premium Exposure

Paid publication, premium exposure, boost windows, subscriptions, and related visibility products are digital services that improve workflow handling and marketplace prominence, but they do not guarantee sale, letting, lead volume, ranking permanence, transaction completion, or commercial outcome. Availability of payment methods depends on enabled gateways and successful transaction confirmation.

6. User Conduct and Risk Allocation

Users must conduct their own due diligence before entering any property or commercial transaction. This includes verifying identity, ownership, title, authority, pricing, approvals, acreage, zoning, valuation, financing, occupation status, encumbrances, and any other facts material to the transaction. Except where liability cannot lawfully be excluded, each user bears responsibility for their own transaction decisions and negotiations.

7. Enquiries, Leads, and Communications

Users may receive enquiries, leads, and platform notices through the site, email, phone, or other supported channels. You must use lead information lawfully, professionally, and only for legitimate property-related purposes. Harassment, spam, scraping, resale of personal data, or misuse of lead details is prohibited.

8. Intellectual Property and Content Licence

You retain ownership of your original content, but by uploading it you grant PFine Real Estate Cloud a non-exclusive licence to host, display, format, moderate, distribute, market, and archive the content as needed to operate, promote, secure, and improve the service. You must not upload content that infringes third-party rights.

9. Availability, Changes, and Suspension

The platform may update features, prices, workflows, policies, and availability from time to time. Access may be limited, suspended, or terminated where required for maintenance, abuse prevention, payment disputes, fraud review, legal compliance, or service protection.

10. Limitation of Liability

To the fullest extent permitted by applicable law, PFine Real Estate Cloud and its owners, staff, contractors, and service providers are not liable for indirect, incidental, consequential, special, exemplary, or lost-profit damages arising from marketplace use, user content, third-party transactions, payment interruptions, fraud, listing errors, downtime, or reliance on information posted by users. Nothing in these terms excludes liability that cannot lawfully be excluded.

11. Indemnity

You agree to indemnify and hold harmless PFine Real Estate Cloud, its owners, staff, contractors, and service providers against claims, complaints, losses, liabilities, costs, and expenses arising from your content, misuse of the platform, breach of these terms, infringement of rights, or unlawful conduct.

12. Governing Framework

These terms are intended to operate consistently with applicable Kenyan law, including consumer and data protection obligations. If any provision is found unenforceable, the remaining provisions will continue in effect.

13. Policy Integration

These Terms of Use should be read together with the Privacy Policy and Refund Policy. Continued use of the platform after updates take effect constitutes acceptance of the revised terms.
